Ordinance No. 809 series of 2024
AN ORDINANCE ESTABLISHING AN ELEMENTARY EDUCATIONAL ASSISTANCE SUBSIDY THRU THE FINANCIAL ASSISTANCE PROGRAM OF THE MUNICIPALITY OF TAYTAY, RIZAL
WHEREAS, Article XIV, Section 1 of the 1987 Constitution provides that “the State shall protect and promote the right of all citizens to quality education at all levels, and shall take appropriate steps to make such education accessible to all”;
WHEREAS, the Philippine Constitution mandates the State to establish a system of scholarship grants, student loan programs, subsidies and other incentives which shall be available to deserving students in both public and private schools, especially to the underprivileged;
WHEREAS, Section 447(a)(5)(xi) of the Local Government Code of 1991 provides that the Sangguniang Bayan has a duty to “establish a scholarship fund for poor but deserving students residing within the municipality in schools located within its jurisdiction”;
WHEREAS, the Department of Education through Department Order No. 031, series of 2022, supports a rights-based education that emphasizes on the right to inclusive, equitable and quality education for students that shall include the disadvantaged, among others;
WHEREAS, the primary educational assistance programs of the national and local government such as the Education Service Contracting Program and the Senior High School Voucher and Taytay Expanded Educational Assistance Program Ordinance of 2022 provide educational assistance to students in the secondary level but does not apply to pupils in the elementary level;
WHEREAS, the Municipal Government of Taytay endeavors to promote the right to quality and accessible education of Taytayeños both in public and private schools within the municipality;
WHEREAS, establishing an Elementary Educational Assistance Subsidy under Financial Assistance Program of the Municipality of Taytay will help lessen the dilemma of pupils and their parents in fulfilling their financial obligations to private educational institutions operating in Taytay, Rizal;
NOW THEREFORE, BE IT ORDAINED, by the 12th Sangguniang Bayan in a session duly assembled that:
Section 1. Short Title - This Ordinance shall be known as the “Taytay Elementary Private School Pupils Educational Assistance Program of 2024”.
Section 2. Scope - This shall cover all DepEd-recognized private schools operating in the territorial jurisdiction of the Municipality of Taytay, Rizal that offer elementary education.
Section 3. Eligibility - The beneficiaries under this Ordinance shall:
- be currently enrolled at the elementary level in a private school operating in Taytay, Rizal,
- be a bonafide resident of the Municipality of Taytay,
- have an outstanding balance / financial obligations in the records of their school, and
- have no other family member included in the beneficiaries of the program under this Ordinance.
Section 4. Selection process - The respective school heads or school administrators shall formulate their own selection process and selection committee following the guidelines set forth by the Municipal Social Welfare and Development Office (MSWDO) and recommend to the Committee on Education thru a formal letter, the list of their chosen beneficiaries for each school.
4.1. Each private schools shall provide the full names and proof of enrolment for the current school year of the beneficiaries during the months of April to June in time for the commencement exercises and enrolment period.
4.2 The Municipal Social Welfare & Development Office shall determine the total number of beneficiaries per school based on availability of funds. The list of beneficiaries shall not be below five (5) pupils per private school.
4.3 The Local Government Unit of Taytay including the Barangay Government shall not, in any way, influence the selection process of the schools.
Section 5. Educational Assistance Grant - The educational assistance shall be in the form of a guarantee letter (GL) or voucher issued under the name of the school and the beneficiary that shall be used solely as payment for any unsettled or overdue school fees. The amount shall not be less than two thousand pesos (Php 2,000) per beneficiary.
Section 6. Implementing Arm - the Municipal Social Welfare and Development Office shall be the lead implementing department of the provisions of this Ordinance following the rules and regulations governing the financial assistance programs of the government. The DepEd Taytay shall regularly provide the MSWDO the updated list of DepEd recognized elementary schools operating in this Municipality.
Section 7. Funding - the funding for this program shall be sourced from any Financial Assistance Program coursed thru the Local Government Unit of Taytay, Rizal.
Section 8. Separability Clause - If any part of this Ordinance is declared not valid, unconstitutional, or unlawful, such declaration shall not affect or impair the remaining provisions, sections, or parts thereof, which shall remain or continue to be in full force and effect.
Section 9. Repealing Clause - All previous ordinances inconsistent with this Ordinance shall be deemed repealed or modified accordingly.
Section 10. Effectivity Clause - This Ordinance shall take effect fifteen (15) days after its posting in conspicuous places and in the local bulletin board.
