A RESOLUTION AUTHORIZING THE MUNICIPAL MAYOR, HON. ALLAN MARTINE S. DE LEON, MPA, TO SIGN AND ENTER INTO A MEMORANDUM OF AGREEMENT AND DEED OF DONATION WITH MUZON MANSIONS HOMEOWNERS ASSOCIATION INC., REPRESENTED BY ITS PRESIDENT, CRISTINA T. GALAPON, PERTAINING TO THE OPEN SPACE AT MUZON MANSIONS SUBDIVISION, BRGY. MUZON IN THE MUNICIPALITY OF TAYTAY, PROVINCE OF RIZAL, AND FOR OTHER PURPOSES
WHEREAS, Section 16 of Republic Act (“R.A.”) No. 7160, otherwise known as the Local Government Code, provides that every local government unit shall exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and shall ensure and support, among other things, the general welfare of its constituents;
WHEREAS, Section 444 (b)(1)(vi) of R.A. No. 7160 empowers the Municipal Mayor to represent the municipality in all its business transactions and sign documents on its behalf, upon authorization from the Sangguniang Bayan;
WHEREAS, Presidential Decree No. 1216 states that there is a need to provide and maintain a healthy and suitable environment for citizens to live by providing open spaces, alleys, sidewalks, and road lots as part of the amenities of the subdivision;
WHEREAS, Muzon Mansions Homeowners, by virtue of a donation, has donated certain open spaces and road lots to Municipal Government on 30 May 2023, as more particularly described in the Deed of Donation executed between the Landisco Corporation and Municipal Government;
WHEREAS, the Municipal Government has accepted said donation and is now the owner of the open spaces and road lots donated;
WHEREAS, the Muzon Mansions Homeowners has also contributed certain properties, such as planting flowers, signage, bench and labor to the Municipal Government for the purpose of improving the open spaces for possible use as a multipurpose park with parking space;
WHEREAS, the Municipality of Taytay recognizes the role of improvising and beautifying open spaces for the general public that can strengthen social cohesion in the local community and enable to transform neighborhoods into safe environments;
WHEREAS, consistent with the goal of providing “Serbisyong May Ngiti” to all Taytayeños, the signing of the MOA with the Muzon Mansions Homeowners Association will further reinforce the Municipality’s mission to implement programs and initiatives that will benefit all its constituents;
WHEREAS, the ratification of the MOA and Deed of Donation between Muzon Mansions Homeowners and the Municipal Government is necessary before its full implementation;
NOW THEREFORE, BE IT RESOLVED, as it is hereby resolved, by the 12th Sangguniang Bayan of Taytay, Rizal, in a session duly assembled, to AUTHORIZE THE MUNICIPAL MAYOR, HON. ALLAN MARTINE S. DE LEON, MPA, TO SIGN AND ENTER INTO A MEMORANDUM OF AGREEMENT AND DEED OF DONATION WITH MUZON MANSIONS HOMEOWNERS ASSOCIATION INC., REPRESENTED BY ITS PRESIDENT, CRISTINA T. GALAPON, PERTAINING TO THE VACANT LOT AT DIAMOND ST., BRGY. MUZON IN THE MUNICIPALITY OF TAYTAY, PROVINCE OF RIZAL.
RESOLVED FINALLY, that copies of this Resolution be forwarded to the Office of the Municipal Mayor, and all concerned offices in the Municipal Government of Taytay.
ADOPTED, this 26th day of March 2025, 2:50 PM at the Sangguniang Bayan Session Hall, Municipality of Taytay, Province of Rizal.
