Resolution No. 326 series of 2023
A RESOLUTION URGING TRICYCLE OPERATORS AND DRIVERS TO OBSERVE NATIONAL LAWS DECLARING FARE DISCOUNTS TO STUDENTS, PWDS, AND SENIOR CITIZENS
WHEREAS, Republic Act 11314 also known as the Student Fare Discount Act signed into Law in 2018 declares in Section 4 that the fare discount for students “shall be available during the entire period while the student is enrolled, including weekends and holidays”;
WHEREAS, Section 5 of the same Act states that a student “shall be entitled to a grant of twenty percent (20%) discount on domestic regular fares, upon personal presentation of their duly issued school identification cards (IDs) or current validated enrollment form”;
WHEREAS, RA 10754 also known as the Act Expanding the Benefits and Privileges of Persons with Disability signed into Law in 2015 declares in Section 6 that Persons with Disability are also entitled to the grant of a 20% discount on the purchase of services such as land transportation travel;
WHEREAS, pursuant to the cited Law above, Memorandum Circular No. 2018 - 004 issued by the Land Transportation Franchising and Regulatory Board (LTFRB) states that Persons with Disabilities should present their respective identification documents, such as, but not limited to identification cards issued by the National Council for the Welfare of Disabled Persons and duly authorized by officials of the Local Government Unit concerned;
WHEREAS, RA 9994 Act Granting Additional Benefits and Privileges to Senior Citizens, Further Amending Republic Act No. 7432, As Amended, otherwise known as “An Act to Maximize the Contribution of Senior Citizens to Nation Building, Grant Benefits, and Special Privileges and for other Purposes also honor the senior citizens a 20% discount on public utility vehicle fares as stated in Section 4;
WHEREAS, the Land Transportation Franchising and Regulatory Board clarified that the fare discounts may be availed in all transport modes, including tricycles;
WHEREAS, the abovementioned laws were expected to be strictly implemented as long as the benefactors complied accordingly, in which, on the other side, certain penalties or sanctions will be imposed on those who violate or neglect these national legislations;
WHEREAS, the Taytay Municipal Tricycle Franchising and Regulatory Board (TMTFRB) is also urged to issue a board resolution to require all TODA operating in Taytay to post information about these discounts inside their tricycle units;
NOW THEREFORE, BE IT RESOLVED, as it is hereby resolved by the 12th Sangguniang Bayan of Taytay, Rizal, in session duly assembled, hereby URGES TRICYCLE OPERATORS AND DRIVERS TO OBSERVE NATIONAL LAWS DECLARING FARE DISCOUNTS TO STUDENTS, PWDS, AND SENIOR CITIZENS.
RESOLVED FURTHER, that a copy of this Resolution be furnished to all associated offices and parties concerned for their information and appropriate action.
