A RESOLUTION AUTHORIZING THE MUNICIPAL MAYOR ALLAN MARTINE S. DE LEON, MPA, TO REQUEST TO THE COMMISSION ON ELECTIONS (COMELEC) FOR AN EXEMPTION FROM THE ELECTION BAN TO ALLOW THE IMPLEMENTATION OF VARIOUS PROGRAMS, PROJECTS AND ACTIVITIES OF THE MUNICIPAL SOCIAL WELFARE AND DEVELOPMENT OFFICE (MSWDO) OF THE MUNICIPALITY OF TAYTAY, PROVINCE OF RIZAL
WHEREAS, pursuant to the Omnibus Election Code, the Commission on Elections (COMELEC) imposes a prohibition on the release, disbursement, or expenditure of public funds during the election period to ensure the integrity of the electoral process and to prevent the misuse of government resources for partisan purposes;
WHEREAS, the Municipality of Taytay, Rizal has various essential programs and projects that are crucial for the welfare of its constituents, including but not limited to infrastructure development, social welfare services, health programs, and disaster risk reduction initiatives;
WHEREAS, the implementation of these programs and projects is necessary for the continuous delivery of basic services, and any delay may adversely affect the community, particularly those in need of immediate assistance and development initiatives;
WHEREAS, the Municipal Welfare and Development Office requested our Local Chief Executive to ask for an exemption to the Commission on Election regarding the prohibition of disbursing public funds due to their scheduled activities, programs and projects within the election period, that aims to address and continuous support the critical needs of our constituents and for the benefit of every residence of this Municipality;
WHEREAS, the Omnibus Election Code also provides that exemptions from the election ban may be granted upon prior authority from the COMELEC when such expenditures are necessary for the continued functioning of government services and programs;
WHEREAS, in compliance to the requirement of the Commission on Election (COMELEC) for the exemption in the prohibition of the election ban the Sangguniang Bayan need to issue a resolution granting authority to the Local Chief Executive to request for the exemption from the prohibition of the election ban for the implementation of the scheduled activities and programs of the MSWDO as part of their Social Welfare and Services Projects;
NOW THEREFORE, BE IT RESOLVED, as it is hereby resolved, by the 12th Sangguniang Bayan of Taytay, Rizal, in session duly assembled, hereby AUTHORIZES THE MUNICIPAL MAYOR ALLAN MARTINE S. DE LEON, MPA, TO REQUEST TO THE COMMISSION ON ELECTIONS (COMELEC) FOR AN EXEMPTION FROM THE ELECTION BAN TO ALLOW THE IMPLEMENTATION OF VARIOUS PROGRAMS, PROJECTS AND ACTIVITIES OF THE MUNICIPAL SOCIAL WELFARE AND DEVELOPMENT OFFICE (MSWDO) OF THE MUNICIPALITY OF TAYTAY, PROVINCE OF RIZAL.
RESOLVED FURTHER, that a copy of this Resolution be furnished to the Commission on Elections (COMELEC), and other concerned agencies for their information and guidance.
ADOPTED, this 12th day of February 2025, 4:36 PM at the Sangguniang Bayan Session Hall, Municipality of Taytay, Province of Rizal.
