Resolution No. 391 series of 2024
CONFORMING THE APPOINTMENT OF ANDRES CALDERON CRUZ JR. AS REPLACEMENT FOR THE VACATED SANGGUNIANG BAYAN MEMBER JEAN LALAINE P. CALDERON
WHEREAS, Section 45 of the Local Government Code of 1991 on Permanent Vacancies, to wit:
“(b). Except for the Sangguniang Barangay, only the nominee of the political party under which the Sanggunian member concerned had been elected and whose elevation to the position next higher in rank created the last vacancy in the Sanggunian shall be appointed in the manner hereinabove provided. The appointee shall come from the same political party as that of the Sanggunian member who caused the vacancy and shall serve the unexpired term of the vacant office. In the appointment herein mentioned, a nomination and a certificate of membership of the appointee from the highest official of the political party concerned are conditions sine qua non, and any appointment without such nomination and certification shall be null and void ab initio and shall be ground for administrative action against the official responsible therefor.”
WHEREAS, Sangguniang Bayan member Jean Lalaine P. Calderon ran under the Nationalist Peoples’s Coalition (NPC) and was elected during the May 9, 2022 National and Local Elections;
WHEREAS, then Councilor Jean Lalaine P. Calderon was duly elected as Punong Barangay last BSKE 2023 and assumed office last December 1, 2023 to perform the duties and responsibilities of Punong Barangay of Barangay Sta. Ana, Taytay, Rizal rendering her position to the 12th Sangguniang Bayan vacant;
WHEREAS, Andres C. Cruz Jr., of legal age, a bona fide and of good standing member of the party and was duly nominated by the highest official of the NPC;
WHEREAS, Andres C. Cruz Jr. was duly appointed by the Governor of the Province on April 8, 2024 to perform the duties and responsibilities of the vacated Sangguniang Bayan member Jean Lalaine P. Calderon;
NOW THEREFORE, BE IT RESOLVED, as it is hereby resolved, CONFORMING THE APPOINTMENT OF ANDRES CALDERON CRUZ JR. AS REPLACEMENT FOR THE VACATED SANGGUNIANG BAYAN MEMBER JEAN LALAINE P. CALDERON.
RESOLVED FURTHER, that copies of the Oath of Office and Appointment shall form part of this Resolution.
RESOLVED FURTHERMORE, that early release of the copies of this Resolution be made and respective copies be furnished to the concerned for their information, guidance and appropriate action.
ADOPTED, this 12th day of April 2024, 2:19 PM at the Sangguniang Bayan Session Hall, Municipality of Taytay, Province of Rizal.
