AN ORDINANCE ALLOWING TRICYCLES TO PASS THROUGH RIZAL AVENUE FROM CORNER MALAYA EXTENSION TO VILLANUEVA STREET, REPEALING ORDINANCE NO. 10 S. 1997
WHEREAS, Section 16 of the General Welfare Clause of RA 7160 provides in part that every local government unit shall exercise powers necessary for its efficient and effective governance and those which are essential to the promotion of the general welfare;
WHEREAS, the Municipal Local Government Unit (LGU) of Taytay, Rizal is committed to ensuring the safety efficient mobility of people and goods within its jurisdiction;
WHEREAS, the municipal government recognizes the role of the tricycle as one of its primary modes of public transportation and their operation greatly affect the mobility of the riding populace;
WHEREAS, there is a need to designate certain streets for the passage of vehicles to improve accessibility and traffic flow;
WHEREAS, Ordinance No. 10 s. 1997 banning Tricycles is already considered obsolete as public transportation should be considered as a mobility solution, rather than a cause of traffic congestion;
WHEREAS, the LGU seeks to allow the passage of tricycles along Rizal Avenue particularly in the poblacion area with regulations on the efficient traffic flow and enhancement of safety for pedestrians and motorists;
NOW THEREFORE, BE IT ORDAINED, as it is hereby ordained, that:
Section 1. Short Title - This Ordinance shall be known as the “Rizal Avenue Tricycle Regulation Ordinance”.
Section 2. Definition of Terms - The following terms are defined for the purposes of this Ordinance:
a. Designated area - portion of Rizal Avenue - corner Malaya Street to Villanueva Street.
b. Motorized Tricycle Operator’s Permit (MTOP) - the document granting franchise or permit to operate issued to a person, natural or juridical, allowing him to operate tricycle over zones specified therein.
c. Out of Route / Line - tricycles operating beyond their designated zone or authorized area of operation.
d. Pedestrian - a person who travels by foot and is intended to walk only on sidewalks or paved paths intended for them.
e. TODA - refers to the Tricycle Operators and Drivers Association.
f. Tricycle - a motor vehicle duly registered with LTO composed of motorcycle fitted with a single-wheeled sidecar or two-wheeled cab, close van or open cart whether powered by gasoline or electricity.
Section 3. Scope - Tricycles shall now be allowed to pass through and drop off passengers along Rizal Avenue from corner Malaya Extension to Villanueva Street, thus repealing the Sangguniang Bayan Ordinance No. 10 series of 1997.
Picking up passengers will only be allowed for senior citizens, persons-with-disabilities, or market-goers with heavy loads, and given that they can only call on tricycles from existing legal terminals in the area, and/or contracted service vehicles.
Section 4. Regulations - Motorized tricycles traversing the designated areas at all times must adhere to all existing regulations and prohibitions covering its operations such as, but is not limited to:
1. Securing / renewing Motorized Tricycle Operator's Permit (MTOP).
2. Operating within prescribed authorized route of operation and designated zones, particularly on loading passengers (out of route / line).
3. Observance of maximum numbers of passengers allowed.
4. Adherence to the tricycle’s physical requirements and equipage set by the TMTFRO.
5. Observance of speed limits.
Section 5. Penalties and Violations - The penalties provided by existing ordinances, rules and regulations regarding motorized tricycles shall remain in full force and effect and shall accordingly be imposed to any person who violates this Ordinance.
Section 6. Obstruction and Traffic Flow
1. It shall be prohibited for any private or public vehicle to obstruct the passage of vehicles along designated areas.
2. Vendors must be prohibited to display or extend their goods on sidewalks as it is intended for pedestrian passage in accordance with Ordinance No. 777 s. 2023 otherwise known as the Ambulant Vendors Regulation Ordinance of Taytay.
3. Vehicles must adhere to all traffic regulations and signage while traversing the designated area.
4. Illegal terminal operations are strictly prohibited; thus, there should be no unauthorized loading or picking of passengers along the designated area.
Section 7. Separability Clause - If, for any reason, any part of the provision of this Ordinance shall be held unconstitutional or invalid, other parts hereof which are not affected thereby shall continue to be in full force and effect.
Section 8. Repealing Clause - Ordinance No. 10 s. 1997 is hereby repealed. All other ordinances, resolutions, circulars, memorandums, or rules and regulations inconsistent with the provision of this Ordinance are hereby repealed and modified accordingly.
Section 9. Effectivity Clause - This Ordinance shall take effect immediately upon its posting at the official social media accounts and at the Municipal Transparency Boards.
