Ordinance No. 810 series of 2024

AN ORDINANCE IMPOSING A TEMPORARY MORATORIUM ON THE ESTABLISHMENT OF NEW GARMENTS LESSOR (ORGANIZERS) IN THE MUNICIPALITY OF TAYTAY, RIZAL


WHEREAS, Section 447(a)(2)(vi) of RA 7160 or the Local Government Code of 1991 states that “(a)The Sangguniang Bayan, as the legislative body of the municipality, shall enact ordinances” that (2) “Generate and maximize the use of resources and revenues for the development plans, program objectives and priorities of the municipality”, and (vi) “Prescribe reasonable limits and restraints on the use of property within the jurisdiction of the municipality”;

WHEREAS, Section 447(a)(3)(ii) and (a)(4) of the same Republic Act indicates that (3) “Subject to the provisions of Book 11 of this Code, grant franchises, enact ordinances authorizing the issuance of permits or licenses, or enact ordinances levying taxes, fees and charges upon such conditions and for such purposes intended to promote the general welfare of the inhabitants of the municipality, and pursuant to this legislative authority shall: (ii) Regulate any business ... within the municipality and the conditions under which the license for said business may be issued or revoked”;

WHEREAS, this Ordinance imposing a temporary moratorium on the issuance of permits to new entities that will operate garments merchandising is for the purpose of regulating the establishment of new tiangge-type garments organizers in the municipality for the benefit of the local stakeholders in the garments industry of Taytay;

NOW THEREFORE, BE IT ORDAINED, by the 12th Sangguniang Bayan in session duly assembled that:

Section 1. A moratorium of six (6) months commencing on the enactment of this ordinance is hereby declared on the establishment of new garments lessor (organizers) and shall remain in full force and effect until after 6 months unless earlier lifted by the Sangguniang Bayan through a subsequent ordinance based on the endorsement of the Local Chief Executive and upon the recommendation of the Local Economic Development and Investment Promotions Office (LEDIPO).

Section 2. During the time that the temporary moratorium is in effect, the Municipal Government of Taytay thru the Business Permit and Licensing Office shall not accept any application or act on any pending applications for business permits or licenses for the establishment or operation of garments lessors (organizers) within the Municipality.

Section 3. On the 5th month of the effectivity of the temporary moratorium, the Municipal Mayor, in consultation with the concerned offices under the executive department and the local garments stakeholders, shall write to the Sangguniang Bayan whether to extend the moratorium for a certain period thru a subsequent ordinance or let the validity of this ordinance lapse as stipulated in Section 1 of this Ordinance.

Section 4. Let a copy of this Ordinance be furnished to the Local Economic Development and Investment Promotions Office or its equivalent, Business Permit and Licensing Office, Engineering Office, Municipal Planning & Development Office and other concerned offices for their information and guidance.

Section 5. If any part or provision of this Ordinance is declared null and void, other parts or provisions not so affected shall remain valid and effective.

Section 6. This Ordinance shall take effect immediately upon approval.
