Ordinance No. 820 series of 2024
AN ORDINANCE APPROVING SUPPLEMENTAL BUDGET NO. 2 AMOUNTING TO THIRTY MILLION FOUR HUNDRED FIFTY-NINE THOUSAND SEVEN HUNDRED THIRTY-SIX PESOS AND 19/100 (PHP 30,459,736.19) TO FUND PRIORITY PROGRAMS, PROJECTS AND ACTIVITIES OF THE MUNICIPAL GOVERNMENT OF TAYTAY
WHEREAS, Ordinance No. 801 s. 2023 was enacted to appropriate the amount of One Billion Seven Hundred Twenty Million Six Hundred Ninety-Five Thousand Two Hundred Twenty-Two Pesos and Seventy-Five Centavos (Php 1,720,695,222.75) as the Annual Budget of the Municipality of Taytay, Province of Rizal for the Fiscal Year 2024 and Other Purposes;
WHEREAS, Department of Budget and Management (DBM) issued Local Budget Circular No. 160 dated August 12, 2024 prescribing the guidelines for the implementation of the first tranche of the modified salary schedule for local government personnel pursuant to Executive Order (EO) No. 64, s. 2024;
WHEREAS, Ordinance No. 818 series of 2024 as amended by Ordinance No. 819 series of 2024, adopted and authorized the local implementation of the first tranche of the modified salary schedule for local government personnel pursuant to Department of Budget and Management Local Budget Circular No. 160;
WHEREAS, Taytay Development Council (TDC) Resolution No. 2024 - 006 entitled: “A Resolution Recommending Approval of the Re-alignment of Funds from PPAs under the 20% Development Fund amounting to Fifteen Million Two Hundred Thousand Pesos (Php 15,200,000.00) to Fund Various Priority Projects, Programs and Activities of the Municipality”, as ratified by SB Resolution No. 470 series of 2024;
WHEREAS, the Sangguniang Panlalawigan through the Provincial Finance Committee report dated March 8, 2024, on SP Resolution 242, S. 2024 recommended the appropriation of the excess 2024 actual National Tax Allocation (NTA) versus the estimated amount in the 2024 annual budget of Taytay, Rizal;
WHEREAS, Taytay Development Council (TDC) Resolution No. 2024 - 003 entitled: “A Resolution Allocating the Amount of Two Million Three Hundred Forty-Seven Thousand Seven Hundred Thirty-One Pesos (Php 2,347,731.00) to the current amount of One Hundred Eighty-Nine Million Five Hundred Fifty-Nine Thousand One Hundred Thirty-Nine Pesos and 60/100 (Php 189,559,139.60) representing the 20% Development Fund FY 2024”, as ratified by SB Resolution No. 468 series of 2024;
WHEREAS, the Municipal Accountant attested that there are unappropriated surplus and savings from current appropriations that are available for Supplemental Appropriation to implement the First Tranche of the modified salary schedule and priority projects, program and activities of Municipal Government of Taytay;
WHEREAS, it is imperative for the Sangguniang Bayan to approve the Supplemental Budget No. 02 amounting to Thirty Million Four Hundred Fifty-Nine Thousand Seven Hundred Thirty-Six Pesos and 19/100 (Php 30,459,736.19) for the fiscal year 2024 to ensure the implementation of priority programs, projects and activities of the Municipal Government of Taytay;
NOW THEREFORE, BE IT ORDAINED, by the 12th Sangguniang Bayan of Taytay, Rizal, in a session duly assembled, that:
Section 1. Appropriation - The amount of Thirty Million Four Hundred Fifty-Nine Thousand Seven Hundred Thirty-Six Pesos and 19/100 (Php 30,459,736.19) is hereby appropriated as integral part of the General Fund Budget for the year 2024 by way of Supplemental No. 02.
The budget documents consisting of the following are incorporated herein and made as integral part of this Ordinance:
1. Statement of Funding Sources signed by the Municipal Treasurer and Municipal Accountant broken down in the following LBP forms which may be found in the LBP Form No. 8: General Fund - 100, General Fund - 01, General Fund – 02, General Fund - 09 and 20% Development Fund.
2. Statement of Supplemental Appropriation signed by the Municipal Mayor and the Municipal Budget Officer broken down in the following LBP forms which may be found in the attached LBP Form No. 9: General Fund - 100, General Fund - 01, General Fund - 02, General Fund - 03, and General Fund - 09.
Section 2. Source of Fund - The source of fund for Supplemental Budget No. 02 is as follows:

Savings from Current Appropriation 28,112,005.19
Total Available for Supplemental Appropriation 30,459,736.19
Section 3. Expenditures - The amount of Thirty Million Four Hundred Fifty-Nine Thousand Seven Hundred Thirty-Six Pesos and 19/100 (Php 30,459,736.19) is hereby appropriated for Supplemental Budget No. 02 as follows:

Section 4. Compliance With Applicable Laws - Disbursement of these funds is subject to the usual accounting and auditing rules and regulations.
Section 5. Separability Clause - If for any reason, any section or provision of this Ordinance is declared to be unconstitutional or invalid, all other provisions hereof which are not affected thereby shall continue to be in full force and effect.
Section 6. Effectivity Clause - This Ordinance shall take effect immediately upon its approval.
