Resolution No. 427 series of 2024

A RESOLUTION EXPRESSING THE SANGGUNIANG BAYAN’S FIRM STAND NOT TO ACCEPT ANY APPLICATION OF PHILIPPINE OFFSHORE GAMING OPERATIONS (POGOS) TO OPERATE WITHIN THE MUNICIPALITY OF TAYTAY, RIZAL


WHEREAS, Section 25, Article II of the 1987 Constitution provides that the State shall ensure the autonomy of local governments;

WHEREAS, also Section 2, Article X of the 1987 Constitution states that the territorial and political subdivisions shall enjoy local autonomy;

WHEREAS, Section 447 of the Republic Act No. 7160 otherwise known as the Local Government Code of 1991 empowers the Sangguniang Bayan to approve and pass resolutions that concern the general welfare of the municipality and its constituents;

WHEREAS, Section 1 of the Republic Act No. 9487 otherwise known as “An Act Further Amending Presidential Decree No. 1869, otherwise known as PAGCOR Chapter” gives the Corporation rights, privileges, and authority to operate and license certain gambling establishments but also provides that the Corporation shall obtain the consent of the local government unit that has territorial jurisdiction over the area chosen as the site for any of its operations;

WHEREAS, Philippine Offshore Gaming Operations recently become the center of national issues being associated with serious criminal allegations such as money laundering and human trafficking;

WHEREAS, neighboring cities such as Pasig and Valenzuela already passed an ordinance banning POGO operations within their jurisdiction, stating its potentially harmful effects on the general public;

WHEREAS, through its mandate, the Taytay Municipal Government shall maintain peace and order, and preserve the comfort and convenience of its inhabitants;

WHEREAS, the Taytay LGU believes that the adverse impact of POGO operations will hinder the social, moral, and economic growth of its residents as well as their safety and security, as this online gambling entity is linked to exploitative and illegal activities;

WHEREAS, given the circumstances mentioned above, the Sangguniang Bayan of Taytay, Rizal deemed it necessary to express its firm stand to not allow any application for the operation and forbid future application of POGOs within the municipality;

WHEREAS, the Sanggunian likewise requests the Local Chief Executive, through the Business Permits and Licensing Office, to be more cautious on approving business permit applications and to conduct inspections and investigations on any suspicious business activities within the municipality;

NOW THEREFORE, BE IT RESOLVED, as it is hereby resolved, by the 12th Sangguniang Bayan of Taytay, Rizal, in a session duly assembled, hereby EXPRESSES THE SANGGUNIANG BAYAN’S FIRM STAND NOT TO ACCEPT ANY APPLICATION OF PHILIPPINE OFFSHORE GAMING OPERATIONS (POGOS) TO OPERATE WITHIN THE MUNICIPALITY OF TAYTAY, RIZAL.

RESOLVED FURTHER, that a copy of this Resolution be furnished to all associated offices and parties concerned for their information and appropriate action.

ADOPTED, this 10th day of July 2024, 3:48 PM at the Sangguniang Bayan Session Hall, Municipality of Taytay, Province of Rizal.
