AN ORDINANCE AMENDING ARTICLE III SECTION 4B OF MUNICIPAL ORDINANCE NO. 12 SERIES OF 2019, OTHERWISE KNOWN AS THE MARKET CODE OF TAYTAY, RIZAL
WHEREAS, the Sangguniang Bayan has enacted the Municipal Ordinance No. 12 series of 2019 otherwise known as the Market Code of 2019 of the municipality;
WHEREAS, Article III Section 4B provides for the rental charges in stalls with booths the amount per square per day to be collected from the lessees of the market;
WHEREAS, the rental charges provided for the aforecited section when implemented will cause financial dislocation on the part of the stall lessees thus forcing them to increase the prices of their products and services which will be very disadvantageous to our constituents;
WHEREAS, there is a need to impose a more reasonable fees to help both the stall lessees and the public;
NOW THEREFORE, BE IT ORDAINED, by the Sangguniang Bayan of Taytay, Rizal, in a session duly assembled that:
Section 1. Article III Section 4B Imposition of Market Fees and charges. Rental charges on stalls with booths, within the market building of the Municipality of Taytay is hereby amended as follows;
For the year 2024 - P 10.00 per square meter a day
For the year 2025 - P 10.00 per square meter a day
For the year 2026 - P 15.00 per square meter a day
For the year 2027 onwards - P 15.00 per square meter a day
Section 2. Article IV Section 10. The Market Committee shall be amended as follows:

Section 10. The Market Committee - A Market Committee composed of the Municipal Mayor or his duly authorized representative, as Chairman, Municipal Treasurer, the Chairman of the Committee on Privatization and Economic Enterprises of the Sangguniang Bayan, Legal Office, Market Master, Municipal Assessor, Municipal Engineering Office, Budget Office as members is hereby created. The Market Committee shall act as the policy maker of the public market. It may revoke or substitute the rules and regulations issued by the Market Master. It shall conduct the drawing of lots and opening of bids in connection with the adjudication of vacant of newly constructed or vacant stalls or booths in the market and to certify the results thereof.
The Market Committee shall also be in charge of conducting annual feasibility studies to determine any adjustments to any of the imposition fees stated in this ordinance. From the results of the study, the committee shall recommend to the Mayor and the Sangguniang Bayan any adjustment necessary to maintain the operations of the market, for appropriate actions.

Section 3. Separability Clause - If, for any reason, any part or provision is declared unconstitutional or invalid, other parts or provisions which are not affected thereby shall continue to be in full force and effect.
Section 4. Effectivity - This Ordinance shall take effect upon approval and upon compliance of the existing rules posting as provided by the Local Government Code of 1991.
Copies of this Municipal Ordinance shall be forwarded to the Sangguniang Panlalawigan, Provincial Capital, Rizal for their review and other offices and authorities concerned for their information, favorable and appropriate action.
