Resolution No. 447 series of 2024

A RESOLUTION AUTHORIZING THE MUNICIPAL MAYOR ALLAN MARTINE S. DE LEON, MPA, TO SIGN INTO A CONTRACT OF LEASE FOR THE MUNICIPAL GOVERNMENT OF TAYTAY, PROVINCE OF RIZAL, WITH THE SMART COMMUNICATIONS INC. REPRESENTED BY ITS MANAGER, NETWORK FIELD SERVICES, LIONAR F. BRIGOLA, AND FOR OTHER PURPOSES

WHEREAS, Section 6, Article XII of the 1987 Constitution provides that “[t]he State recognizes the vital role of communication and information in nation-building”;

WHEREAS, to further enrich the communication infrastructure within the Municipality and in order to expand the services of Smart Communications, Inc. (“SMART”), which shall benefit the Taytay constituents, the Municipal Government of Taytay agrees to lease an area within the Taytay Municipal Hall to establish a SMART Cell Site;

WHEREAS, a Contract of Lease shall be established between SMART and the Municipal Government, serving as an official agreement granting SMART the right to lease a designated area at the Taytay Municipal Hall located at Don Hilario Cruz Avenue, Barangay San Juan, Taytay, Rizal;

WHEREAS, consistent with the goal of providing Serbisyong May Ngiti to all Taytayeños, the signing of the Contract of Lease is necessary to provide much needed social and telecommunication services that will facilitate access to all Taytayeños;

NOW THEREFORE, BE IT RESOLVED, as it is hereby resolved, by the 12th Sangguniang Bayan of Taytay, Rizal, in a session duly assembled, hereby AUTHORIZES THE MUNICIPAL MAYOR ALLAN MARTINE S. DE LEON, MPA, TO SIGN INTO A CONTRACT OF LEASE FOR THE MUNICIPAL GOVERNMENT OF TAYTAY, PROVINCE OF RIZAL, WITH THE SMART COMMUNICATIONS INC. REPRESENTED BY ITS MANAGER, NETWORK FIELD SERVICES, LIONAR F. BRIGOLA, AND FOR OTHER PURPOSES.

RESOLVED FURTHER, that the Contract of Lease entered into by the Municipal Mayor and Smart Communication Inc. be ratified by the Sangguniang Bayan before its full implementation.

RESOLVED FURTHERMORE, that copies of this Resolution be forwarded to the Office of the Municipal Mayor, and all concerned offices in the Municipal Government of Taytay.

ADOPTED, this 26th day of July 2024, 2:51 PM at the Sangguniang Bayan Session Hall, Municipality of Taytay, Province of Rizal.
