Ordinance No. 802 series of 2024
AN ORDINANCE EXEMPTING TRICYCLE OWNERS AND OPERATORS OF REGISTERED PUBLIC UTILITY TRICYCLES IN THE MUNICIPALITY OF TAYTAY FROM THE ANNUAL PAYMENT OF THE PERMIT TO OPERATE OR RENEWAL FEE FOR THE YEAR 2024 AND PRESCRIBING RULES THEREOF
WHEREAS, Tricycle Drivers and Operators are required by law to issue twenty percent (20%) discounts to students (RA 11314), Senior Citizens (9994), and PWDs (10754), but do not receive any tax relief from the government for providing these discounts;
WHEREAS, Tricycle Drivers and Operators therefore, shoulder these discounts, which technically are deducted from their regular income;
WHEREAS, it is imperative for this local government unit to provide support and subsidy to Tricycle Drivers and Operators - who provide the most accessible form of public transportation in the municipality - in order for them to recover from the mandatory discounts required by existing national laws;
WHEREAS, a lot of our Tricycle Drivers and Operators are still recovering from the impact of the pandemic to the transport sector, and this temporary relief could help in their recovery;
WHEREAS, the committee on Transportation and Mobility has received a letter from the Officer-in-Charge of the Taytay Municipal Tricycle Franchising and Regulatory Office, and the current Head of the Business Permit and Licensing Office, requesting for the exemption of Tricycle Drivers from the Franchising Permit for the year 2024, attached in this resolution as Annex A ;
WHEREAS, Municipal Ordinance No. 44 series of 1999, and its’ subsequent amendments, prescribed the rules and regulations relative to the issuance of tricycle franchise within the Municipality of Taytay, portions of which may be repealed by this Ordinance;
NOW THEREFORE, BE IT ORDAINED, as it is hereby ordained, by the 12th Sangguniang Bayan of Taytay, Province of Rizal, in a session duly assembled, that:
Section 1. Exemption from Fees - All Tricycle Renewal Fees shall be waived for the year 2024 as a form of government subsidy for Tricycle Drivers and Operators in the Municipality of Taytay observing the provision of 20% discounts for Students, Senior Citizens, and PWDs, as prescribed by National Laws. This year shall also be a trial period for the permanent waiving of Tricycle renewal fees, based on the compliance of the tax-relief beneficiaries to the Tricycle Code, and the observance of the aforementioned national discount laws.
Section 2. Qualifications - Only Tricycle Operators and Drivers who are residents of Taytay and are in good standing can avail of this tax exempt. Tricycle Drivers and Operators shall be required to get a residential certificate from their respective barangays as proof of residency.
2.1 Tricycle Operators and Drivers in good standing shall be defined as those who have paid their permit fee for the previous year and have no standing violation records at the BPLO or the TMTFRO.
Section 3. Validity - This exemption shall only be valid for the year 2024.
Section 4. Monitoring of Compliance - The Taytay Municipal Tricycle Franchising and Regulatory Office (TMTFRO) in coordination with the Business Permit and Licensing Office shall be in-charged of monitoring the records and compliance of tricycle drivers and operators to the mandatory discounts and other existing rules indicated in the Municipal Tricycle Code.
The Tricycle Drivers and Operators shall be required to post the mandatory 20% fare discount to senior citizens, students, and PWDs within their tricycle units.
An official Hotline Number and Facebook Page shall be established by the TMTFRO to monitor reports and complaints involving tricycle drivers and operators, and the riding public.
Section 5. Implementing Rules and Regulations - The Tricycle Franchising and Regulatory Board and the Municipal Legal Office shall issue the implementing rules and regulations of this Ordinance within fifteen (15) days after its effectivity.
Section 6. Separability Clause - If any section or part of this Ordinance is held unconstitutional or invalid, the other sections or provisions not otherwise affected shall remain in full force or effect.
Section 7. Repealing Clause - All other Taytay Municipal ordinances, orders, issuances, rules, and regulations that are inconsistent with the provisions of this Ordinance are hereby repealed, amended, or modified accordingly.
Section 8. Effectivity Clause - This Ordinance shall take effect ten (10) days after posting in the Taytay Transparency boards.
