A RESOLUTION AUTHORIZING OUR LOCAL CHIEF EXECUTIVE, HON. ALLAN MARTINE S. DE LEON, MPA, IN BEHALF OF THE MUNICIPALITY OF TAYTAY, RIZAL TO ENTER INTO AND SIGN A MEMORANDUM OF AGREEMENT (MOA) WITH THE NATIONAL AUTHORITY FOR CHILD CARE (NACC) FOR THE IMPLEMENTATION OF THE PHILIPPINE FOSTER CARE PROGRAM
WHEREAS, Republic Act No. 10165, also known as the “Foster Care Act of 2012”, provides for the establishment of a foster care system that promotes the rights and welfare of children in need of alternative family care;
WHEREAS, Republic Act No. 11642, also known as the “Domestic Administrative Adoption and Alternative Child Care Act” provides for the establishment of the National Authority for Child Care that shall exercise all powers and functions relating to alternative child care including, declaring a child legally available for both domestic, administrative adoption and inter-country adoption, foster care, kinship care family-like care or residential care through a simpler, expeditious, inexpensive and streamlined process and services for the best interest of the child;
WHEREAS, the National Authority for Child Care (NACC), as the lead agency for foster care services, is mandated to facilitate and oversee the implementation of foster care programs in partnership with Local Government Units (LGUs) and other stakeholders;
WHEREAS, the Municipal Government of Taytay, Rizal recognizes the importance of providing a safe and nurturing family environment for children who are abandoned, neglected, or at risk, and is committed to supporting the Philippine Foster Care Program;
WHEREAS, the National Authority for Child Care (NACC) shall manage the implementation and monitor the Domestic Administrative Adoption and Alternative Care and provide guidance, policies, technical assistance, capability and sustainability-building activities related to case management of children for domestic and inter-country adoption and foster care;
WHEREAS, the Municipal Government of Taytay, Rizal shall designate a licensed social worker or workers who shall handle the adoption and alternative childcare programs and services, and assess the eligibility and suitability of prospective adoptive and foster parents;
WHEREAS, this Memorandum of Agreement outlined the obligations of the parties and the other terms and conditions of the partnership including the allocation of fund and resources in the Annual Investment Plan and other annual budget plans for the implementation of the programs and other related services, subject to existing accounting and auditing rules;
WHEREAS, in order to provide the utmost care to those child or children who are victims of neglect, abandonment, abuse, violence and cruelty, as well as those children in need of special protection, it is deemed necessary to authorize our Local Chief Executive to sign and enter into a Memorandum of Agreement (MOA) with the National Authority for Child Care to ensure the successful implementation of the Philippine Foster Care Program within the jurisdiction of this Municipality;
NOW THEREFORE, BE IT RESOLVED, as it is hereby resolved, by the 12th Sangguniang Bayan of Taytay, Rizal, in a session duly assembled, hereby AUTHORIZES OUR LOCAL CHIEF EXECUTIVE, HON. ALLAN MARTINE S. DE LEON, MPA, IN BEHALF OF THE MUNICIPALITY OF TAYTAY, RIZAL TO ENTER INTO AND SIGN A MEMORANDUM OF AGREEMENT (MOA) WITH THE NATIONAL AUTHORITY FOR CHILD CARE (NACC) FOR THE IMPLEMENTATION OF THE PHILIPPINE FOSTER CARE PROGRAM.
RESOLVED FURTHER, that the duly signed Memorandum of Agreement with the National Authority for Child Care (NACC) shall be ratified first by the members of the Sangguniang Bayan before its full implementation.
RESOLVED FURTHERMORE, that copies of this Resolution be furnished to the Office of the Municipal Mayor, the National Authority for Child Care, the Department of Social Welfare and Development (DSWD), and other concerned offices for their information and appropriate action.
