Resolution No. 305 series of 2023
A RESOLUTION AUTHORIZING THE MUNICIPAL MAYOR, ALLAN MARTINE S. DE LEON, MPA, TO SIGN AND ENTER INTO A MEMORANDUM OF AGREEMENT WITH MANILA WATER PERTINENT TO THE TOKA-TOKA PROGRAM IN THE MUNICIPALITY OF TAYTAY, PROVINCE OF RIZAL AND FOR OTHER PURPOSES
WHEREAS, Section 16, Article II of the 1987 Constitution mandates the State to “protect and advance the right of the people to a balanced and healthful ecology in accord with the rhythm and harmony of nature”;
WHEREAS, Section 3(i) of Republic Act (“R.A.”) No. 7160, otherwise known as the Local Government Code of 1991, requires Local Government Units (“LGUs”) to “share with the national government the responsibility in the management and maintenance of ecological balance within their territorial jurisdiction”;
WHEREAS, Section 444(b)(1)(vi) of R.A. No. 7160, provides that the Municipal Mayor, upon authorization by the Sangguniang Bayan, may represent the municipality in all its business transactions and sign on its behalf all bonds, contracts, and obligations, and such other documents made pursuant to law or ordinance;
WHEREAS, Manila Water is a public utility with a legislative franchise under Republic Act No. 11601 entitled, “An Act Granting Manila Water Company, Inc. a Franchise to Establish, Operate, and Maintain the Waterworks and Sewerage System in the East Zone Service Area of Metro Manila and Province of Rizal” and is a concessionaire of Metropolitan Waterworks and Sewerage System;
WHEREAS, Manila Water is devoted to its advocacy on used water and its effects on rivers, while taking its share on the continuing mandamus on the Manila Bay clean up, particularly the conduct of desludging services, collectively known as the Toka-toka Program (“Toka-toka Program”). The Toka-toka Program will also include developing awareness on environmental protection, responsible use of water and wastewater management projects, and other environmental and sustainability programs, and wastewater management;
WHEREAS, Manila Water stakeholders are invited to do their part in reviving rivers and waterways to protect the environment;
WHEREAS, the Municipal Government of Taytay expressed its interest to partner with Manila Water on the execution of the Toka-Toka Program by entering into a Memorandum of Agreement to aid and promote said Program within the Municipality of Taytay;
WHEREAS, in order to properly perform the duties of the Municipal Government with sincere care for the Taytayeños and the environment, while enshrining the principle of Serbisyong May Ngiti, the signing of said Memorandum of Agreement is necessary;
NOW THEREFORE, BE IT RESOLVED, as it is hereby resolved, by the 12th Sangguniang Bayan of Taytay, Rizal, in session duly assembled, to AUTHORIZE THE MUNICIPAL MAYOR, ALLAN MARTINE S. DE LEON, MPA, TO SIGN AND ENTER INTO A MEMORANDUM OF AGREEMENT WITH MANILA WATER PERTINENT TO THE TOKA-TOKA PROGRAM IN THE MUNICIPALITY OF TAYTAY, PROVINCE OF RIZAL AND FOR OTHER PURPOSES.
RESOLVED FURTHER, that copies of the Memorandum of Agreement shall be forwarded to the Office of the Municipal Mayor, and all concerned offices in the Municipal Government of Taytay.
RESOLVED FINALLY, that a copy of this Resolution shall be forwarded to the Office of the Municipal Mayor, and all concerned offices in the Municipal Government of Taytay.
ADOPTED, this 11th day of October 2023, 3:57 PM at the Sangguniang Bayan Session Hall, Municipality of Taytay, Province of Rizal.
