AN ORDINANCE ADOPTING AND AUTHORIZING THE LOCAL IMPLEMENTATION OF THE FIRST TRANCHE OF THE MODIFIED SALARY SCHEDULE FOR LOCAL GOVERNMENT PERSONNEL PURSUANT TO DEPARTMENT OF BUDGET AND MANAGEMENT (“DBM”) LOCAL BUDGET CIRCULAR NO. 160 S. 2024, AND FOR OTHER PURPOSES
WHEREAS, Section 16 of Republic Act (“R.A.”) No. 7160, otherwise known as the Local Government Code, mandates that “every local government unit shall exercise the powers expressly granted, those necessarily implied there from, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare”;
WHEREAS, Section 447(v) of the R.A. No. 7160 authorizes the Sangguniang Bayan, as the legislative body of the municipality, to enact ordinances, approve resolutions and appropriate funds for the general welfare of the municipality and its inhabitants;
WHEREAS, pursuant to Section 447(viii) of R.A. No. 7160, the Sangguniang Bayan has the power to determine the positions and the salaries, wages, allowances and other emoluments and benefits of municipal officials and employees paid wholly or mainly from municipal funds;
WHEREAS, Section 447(a)(1)(xi) of the R.A. No. 7160, as amended, grants the Sangguniang Bayan the authority to determine the compensation of officials and employees of the local government unit, subject to the provisions of R.A. No. 6758, otherwise known as the “Compensation and Position Classification Act of 1989”, as well as the limitations set forth by the Department of Budget and Management (“DBM”) and other pertinent laws;
WHEREAS, the DBM issued Local Budget Circular No. 160 dated 12 August 2024, providing guidelines for the Implementation of the First Tranche of the Modified Salary Schedule for Local Government Personnel Pursuant to Executive Order (“E.O.”) No. 64, s. 2024;
WHEREAS, in recognition of the need to provide competitive and equitable compensation to Local Government Unit (“LGU”) officials and employees, it is deemed necessary to adjust their salaries to align with current economic conditions and to ensure that their compensation reflects their responsibilities and contributions to the effective functioning of the LGU;
NOW THEREFORE, BE IT ENACTED, as it is hereby enacted, by the 12th Sangguniang Bayan of Taytay, Rizal, in session duly assembled, that:
Section 1. Title - This Ordinance shall be known as the “Ordinance Localizing the Implementation of the First Tranche of the Modified Salary Schedule for Local Government Personnel”.
Section 2. Purpose - The purpose of this Ordinance is to adopt and implement the provisions of DBM Local Budget Circular No. 160 s. 2024, thereby modifying the salary schedule for personnel within the Municipal Government of Taytay, and to ensure that the salaries of LGU personnel are adjusted in accordance with the prescribed guidelines.
Section 3. Coverage - This Ordinance shall apply to all officials and employees of the Local Government Unit of Taytay, whether regular, casual, or contractual, who are appointed to government service and are receiving salaries from the municipal budget, except those who are not covered under the salary schedule as provided in DBM Circular No. 160 s. 2024.
Section 4. Salary Schedule and Implementation - The 1st tranche of the modified salary schedule will be effective and retroactively on 02 August 2024 and in accordance with the provisions of the circular.
Section 5. Separability Clause - If for any reason, any section or provision of this Ordinance shall be declared to be unconstitutional or invalid by competent authority, such declaration shall not affect or impair the other sections or provisions not affected thereby.
Section 6. Repealing Clause - All ordinances, rules and regulations, or part thereof, in conflict with, or inconsistent with any provision of this Ordinance are hereby repealed or modified accordingly
Section 7. Effectivity Clause - This Ordinance shall take effect immediately upon approval thereof.
