Ordinance No. 798 series of 2023
AN ORDINANCE REGULATING THE USE OF ANY UNUSED RECYCLABLE OBJECTS AS MATERIALS FOR COSTUMES AND DECORATIONS FOR ANY EVENTS, CONTESTS OR PROGRAMS IN THE MUNICIPALITY OF TAYTAY, RIZAL AND PRESCRIBING PENALTIES THEREOF
WHEREAS, Section 2 of Republic Act 9003, also known as the Ecological Solid Waste Management Act of 2000, states that it is a declared policy of the State to adopt a systematic, comprehensive and ecological solid waste management program which shall:
(a) Ensure the protection of public health and environment;
(b) Utilize environmentally-sound methods that maximize the utilization of valuable resources and encourage resource conservation and recovery;
(c) Set guidelines and targets for solid waste avoidance and volume reduction through source reduction and waste minimization measures, including composting, recycling, re-use, recovery, green charcoal process, and others, before collection, treatment and disposal in appropriate and environmentally sound solid waste management facilities in accordance with ecologically sustainable development principles;
WHEREAS, Section 17(i) of the same law prescribes that the LGU shall educate and inform its citizens about the source reduction, recycling, and composting programs and the source reduction component shall include a program that will show the methods by which the LGU will, in combination with the recycling and composting components, reduce a sufï¬cient amount of solid waste disposed;
WHEREAS, some materials used in making “recycled” and supposedly eco-friendly costumes and decorations for contests, events, activities and programs in schools, communities, puroks, sitios, barangays in the municipality are sometimes new or unused which is not in line with the state’s policy and the environmental, recycling component of the YES Program of the province and the Local Government Unit of Taytay, thus adding to the volume of solid waste produced;
NOW THEREFORE, BE IT ORDAINED, by the 12th Sangguniang Bayan of Taytay, Rizal, in a session duly assembled, that:
Section 1. Short Title - This Ordinance shall be known as the: “Unused Recyclable Materials Regulation Ordinance”.
Section 2. Definition of Terms - As used in this Ordinance, the following term shall mean:
1. Organizer - any entity, main organizer, company, CEO, school administration that spearheads recycling and environment friendly contests within the jurisdiction of Taytay, Rizal.
2. Recycled Costume - any type of outfit worn to create the appearance or characteristic that promotes awareness on environmental protection and recycling.
3. Unused Recyclable Materials - any materials, including plastic-made items and packaging (such as straws, plastic utensils, garbage bags, etc.) paper, cardboard, styrofoam, glass, most forms of metal, and food that have been unused for its intended purpose.
Section 3. Regulation on the Use of Recyclable Materials - The following regulations shall be imposed as follows:
a. The use of unused recyclable materials as part of a contestant’s costume or props in any contest, competition or event within the municipality of Taytay shall be prohibited;
b. The use of unused recyclable materials as part of any decorations or entries in any contest, competition or event (such as, but not limited to Christmas tree, parol making, festivals, pageants, costume parties, etc.) within the municipality of Taytay shall be prohibited;
c. Purchasing of recyclable materials with the intention of using such items for costumes, props, decorations or ornaments shall likewise be prohibited;
d. Organizers and contestants are mandated to use legitimately used recycled materials, in lieu of the unused recyclable materials;
e. Organizers are mandated to include in the mechanics or criteria of their contest, competition or event, the regulations stipulated in this ordinance;
f. Health care materials / waste shall not be allowed as it poses hazard to the general public; and
g. Hazardous materials / waste shall not be allowed as it poses hazard to the general public.
Section 4. Municipal, Barangay Materials Recovery Facilities (MRF) and School MRF - The Municipal, Barangay Governments and School Administrations shall allow access to materials from their Materials Recovery Facilities or the likes to be used for activities that promote proper solid waste management.
Section 5. Roles of the Barangay and the School Administration - The Barangay Environment & Natural Resources shall monitor events within their jurisdiction and inspect for violations thereof. Schools shall monitor that all their programs and competitions will follow proper recycling, upcycling, and proper waste disposal especially for used materials and abide by the provisions of this Ordinance.
Section 6. Roles of the Municipal Environment and Natural Resources Ofï¬ce (MENRO) - The MENRO shall spearhead the implementation of this Ordinance and shall conduct information and education campaigns regarding the types of recyclables and proper waste disposal. The MENRO shall update the public from time to time regarding the types of recyclables and wastes for proper adherence to this Ordinance. The initial list provided by MENRO shall form part of this Ordinance as “Annex A”.
Section 7. Proper Disposal of Used Costumes and Decorations - All used costumes, decorations, props, and the likes shall be surrendered to the nearest MRF of the Barangay or school for recycling, upcycling or proper disposal.
Section 8. Penal Provision - For every violation of the provisions of this Ordinance shall equation the following penalties:
For the Organizer of any contest, competition, program or event ................ a fine of Php 2,500.00 shall be meted to the main organizer for violation of Section 3 of this Ordinance.
For the Contestant or Participant ................ a fine of Php 1,000.00 shall be meted to the contestant and shall result in an automatic disqualification from the said contest or competition. For violators who are minors, their handler, parents or legal guardians shall be liable for the violation of Section 3 of this Ordinance.
The Barangay he or she is residing shall be notiï¬ed of this violation and prevent him or her from acquiring Barangay Clearance unless the payment is made to the Municipal Treasury Office.
Section 9. Separability Clause - If any part of this Ordinance is declared not valid, unconstitutional or unlawful, such declaration shall not affect or impair the remaining provisions, sections or parts thereof, which shall remain or continue to be in full force and effect.
Section 10. Repealing Clause - All previous ordinances inconsistent with this Ordinance shall be deemed repealed or modified accordingly.
Section 11. Effectivity Clause - This Ordinance shall take effect fifteen days (15) after its posting in conspicuous places and on the local bulletin board of the Local Government of Taytay, Rizal.
