Resolution No. 152 series of 2024

A RESOLUTION JOINING THE CALL OF THE PROVINCIAL GOVERNMENT OF RIZAL FOR THE DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES TO BAN MINING AND QUARRYING WITHIN THE PROVINCE OF RIZAL

WHEREAS, typhoon Enteng’s onslaught in September 2024 brought catastrophic effects to the country, particularly in the province of Rizal which caused massive floods and landslides, resulting in significant property damage and multiple casualties;

WHEREAS, as per Governor Nina Ricci A. Ynares’ official post, the Provincial Government of Rizal, through its Sangguniang Panlalawigan, has consistently called for a ban on mining in the province in the way of enacting ordinances and resolutions, as well as communication letters addressed to the national government, dating back to 2010;

WHEREAS, even though this proposition was made in consideration of the general welfare of Rizal’s constituents, the aforementioned ordinances were unfortunately dismissed and declared null and void by the regional court, seconded by the Department of Environment and Natural Resources (DENR), which implied that mining had almost no impact on the flooding;

WHEREAS, in Taytay, one of the province’s low-lying municipalities, flooding consistently causes disastrous effects that include damage to properties and establishments, disruption of work and classes, loss of resources, and even loss of lives;

WHEREAS, it is explicitly supplied that the State shall protect and advance the right of the people to a balanced and healthful ecology, in harmony with the rhythm of nature as directly provided in Section 16, Article II of the 1987 Constitution;

WHEREAS, following this constitutional provision, local governments are mandated to promote health and safety and enhance the people’s right to a balanced ecology as part of their responsibility to promote the general welfare of their constituents within their respective territorial jurisdictions, as stated in the Local Government Code of 1991;

NOW THEREFORE, BE IT RESOLVED, as it is hereby resolved, by the 12th Sangguniang Bayan of Taytay, Rizal, in a session duly assembled, hereby JOINS THE CALL OF THE PROVINCIAL GOVERNMENT OF RIZAL FOR THE DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES TO BAN MINING AND QUARRYING WITHIN THE PROVINCE OF RIZAL.

RESOLVED FURTHER, that a copy of this Resolution be furnished to all associated offices and parties concerned for their information and appropriate action.

ADOPTED, this 16th day of October 2024, 2:39 PM at the Sangguniang Bayan Session Hall, Municipality of Taytay, Province of Rizal.
