A RESOLUTION AUTHORIZING THE LOCAL CHIEF EXECUTIVE, MAYOR ALLAN MARTINE S. DE LEON, MPA TO NEGOTIATE AND ENTER INTO A MEMORANDUM OF AGREEMENT WITH THE TECHNICAL EDUCATION AND SKILLS DEVELOPMENT AUTHORITY (TESDA) RIZAL, REPRESENTED BY ITS PROVINCIAL DIRECTOR, PD MARIA A. ROQUE, ED.D. FOR THE TECHNICAL AND VOCATIONAL EDUCATION AND TRAINING (TVET) DEVOLUTION PROCESS
WHEREAS, Section 16 of R.A. 7160 provides that “Every Local Government Unit shall exercise the powers expressly granted, those necessarily implied therefrom, as well as the powers necessary, appropriate or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare”;
WHEREAS, Section 444 (b) (1) (vi) of R.A. 7160 further provides that “Upon authorization of the Sangguniang Bayan, the Local Chief Executive shall represent the municipality in all of its business transactions and sign on its behalf all bonds, contracts and obligations, and such other documents made pursuant to law or ordinances”;
WHEREAS, Section 29 of R.A. 7796 mandates TESDA to devolve its training functions to local governments and formulate, implement and finance a speciï¬c plan to develop the capability of LGUs to assume the responsibility for effectively providing community-based technical education and skills development opportunities;
WHEREAS, Executive Order No. 138 s. 2021 directs all departments of the Executive Branch whose functions are in line with the devolved functions of the LGU under pertinent laws to fully devolve their functions, services and facilities to the LGUs no later than the end of FY 2024;
WHEREAS, to maximize the full potential of the services to Taytayeños of the TESDA Rizal Office which is housed in the Municipality of Taytay by discussing the phase-by-phase devolution process, an authorization for the executive department is necessary;
NOW THEREFORE, BE IT RESOLVED, as it is hereby resolved, by the 12th Sangguniang Bayan of Taytay, Rizal, in session duly assembled, hereby AUTHORIZES THE LOCAL CHIEF EXECUTIVE, MAYOR ALLAN MARTINE S. DE LEON, MPA TO NEGOTIATE AND ENTER INTO A MEMORANDUM OF AGREEMENT WITH THE TECHNICAL EDUCATION AND SKILLS DEVELOPMENT AUTHORITY (TESDA) RIZAL, REPRESENTED BY ITS PROVINCIAL DIRECTOR, PD MARIA A. ROQUE, ED.D. FOR THE TECHNICAL AND VOCATIONAL EDUCATION AND TRAINING (TVET) DEVOLUTION PROCESS.
RESOLVED FURTHER, that the Memorandum of Agreement shall be ratiï¬ed by the Sangguniang Bayan before its full implementation.
RESOLVED FURTHERMORE, that copies of this Resolution be furnished to the Office of the Mayor, PESO Taytay and TESDA Provincial Ofï¬ce for their information and appropriate actions.
