Resolution No. 438 series of 2024

A RESOLUTION HUMBLY RECOMMENDING AND REQUESTING THE SANGGUNIANG PANLALAWIGAN OF RIZAL TO PASS AN ORDINANCE FOR THE CREATION OF A NEW BARANGAY AT LUPANG ARENDA DERIVED FROM BARANGAY STA. ANA, TAYTAY, RIZAL


WHEREAS, Section 6 of the Local Government Code provides that: “[a] local government unit may be created, divided, merged, abolished, or its boundaries substantially altered either by law enacted by Congress in the case of a province, city, municipality, or any other political subdivision, or by ordinance passed by the Sangguniang Panlalawigan or Sangguniang Panlungsod concerned in the case of a Barangay located within its territorial jurisdiction, subject to such limitations and requirements prescribed in this Code”;

WHEREAS, Section 385 of the same Code also provides that “[a] Barangay may be created, divided, merged, abolished, or its boundary substantially altered, by law or by an ordinance of the Sangguniang Panlalawigan or Sangguniang Panlungsod, subject to approval by a majority of the votes cast in a plebiscite to be conducted by the Comelec in the local government unit or units directly affected within such period of time as may be determined by the law or ordinance creating said Barangay. In the case of the creation of Barangays by the Sangguniang Panlalawigan, the recommendation of the Sangguniang Bayan concerned shall be necessary”;

WHEREAS, Section 386 of the Local Government Code further provides the following requisites for the creation of a barangay, to wit:

1. That the territory to be created should be continuous or physically in contact with each other. However, if the territory is composed of two or more islands, the territory need not be contiguous.

2. In cities and municipalities within Metro Manila and other metropolitan political subdivision, the territory has a population of at least two thousand (2,000) inhabitants as certified by the National Statistics Offices.

3. The creation of the barangay shall not reduce the population of the barangay or barangays to less than the minimum requirements.


4. The territorial jurisdiction of the new barangay shall be properly identified by metes and bounds or by more or less permanent natural boundaries.

WHEREAS, Lupang Arenda as per approved Plan RS-04-00427 has a total land area of 171 hectares;

WHEREAS, based on the 2020 Census of Population and Housing (2020 CPH), Barangay Sta. Ana, has a total population of 107,415 persons. The proposed Barangay in Lupang Arenda will have an estimated population count of 49,920 persons and Barangay Sta. Ana which is the Mother Barangay shall have a population count of 57,495 persons;

WHEREAS, on April 28, 2023, the 8th Sangguniang Barangay of Sta. Ana adopted Resolution 060 S. 2023, Expressing Support to the Clamour of Barangay Sta. Ana Inhabitants to Declare Lupang Arenda as an Independent Barangay and Setting their Boundaries as per Approved Plan RS – 00427;

NOW THEREFORE, BE IT RESOLVED, as it is hereby resolved, by the 12th Sangguniang Bayan of Taytay, Rizal, in a session duly assembled, to HUMBLY RECOMMEND AND REQUEST THE SANGGUNIANG PANLALAWIGAN OF RIZAL TO PASS AN ORDINANCE FOR THE CREATION OF A NEW BARANGAY AT LUPANG ARENDA DERIVED FROM BARANGAY STA. ANA, TAYTAY, RIZAL.
RESOLVED FURTHER, that copies of this Resolution be furnished to all offices concerned for their information and appropriate action.

ADOPTED, this 17th day of July 2024, 4:15 PM at the Sangguniang Bayan Session Hall, Municipality of Taytay, Province of Rizal.
