A RESOLUTION AUTHORIZING THE MUNICIPAL MAYOR, HON. ALLAN MARTINE S. DE LEON, MPA, TO SIGN AND ENTER INTO A MEMORANDUM OF AGREEMENT AND DATA PROCESSING AGREEMENT WITH THE INNOVISION PREMIER CORP. REPRESENTED BY ITS PRESIDENT AND CEO, MR. NOEL DELOS REYES, FOR THE INTERCONNECTION OF TRAFFIC APPREHENSION SYSTEMS WITH THE LAND TRANSPORTATION MANAGEMENT SYSTEM IN THE MUNICIPALITY OF TAYTAY, PROVINCE OF RIZAL, AND FOR OTHER PURPOSES
WHEREAS, Republic Act (“R.A.”) No. 4136, as amended, mandates the Land Transportation Office (“LTO”) to register all motor vehicles, issue licenses to drivers, and enforce transportation laws for the benefit of public welfare;
WHEREAS, Section 23 of R.A. No. 4136, as amended by Republic Act No. 10930, and its Implementing Rules and Regulations (“IRR”) require Local Government Units (LGUs), the Metropolitan Manila Development Authority (MMDA), or other lawful agencies issuing traffic violations to report traffic violations to the LTO, which will serve as the repository of such records;
WHEREAS, the interconnection of the LGU’s traffic apprehension system with the LTO’s Land Transportation Management System (“LTMS”) is essential for implementing the LTO’s Law Enforcement and Traffic Adjudication System (“LETAS”) and ensuring efficient enforcement of traffic regulations;
WHEREAS, R.A. No. 7160, or the Local Government Code of 1991, grants LGUs the authority to regulate traffic within their jurisdiction and cooperate with national agencies to implement traffic laws and ordinances effectively;
WHEREAS, the Electronic Commerce Act of 2000 (R.A. No. 8792) supports the use of electronic means for intergovernmental communication and collaboration, promoting transparency and efficiency in public services;
WHEREAS, R.A. No. 10173, or the Data Privacy Act of 2012, mandates the protection of personal information, and the Data Sharing Agreement (“DSA”) between the LGU and LTO ensures compliance with privacy standards in the exchange of motorist data for enforcement purposes;
WHEREAS, the proposed Memorandum of Agreement (“MOA”) and Data Processing Agreement (“DPA”) between the Municipal Government of Taytay and the Innovision Premier Corp. is in connection with the sharing and processing of personal data arising from the Municipal Government’s interconnectivity with the LTMS and/or other applicable database or system of the LTO, for purposes of the Municipal Government’s enforcement and implementation of its ordinances, laws, rules, and regulations through physical or contact, non-contact, and other lawful modes of apprehensions or law enforcement, and compliance with Republic Act No. 10930 and its IRR, including the tagging of alarms on the motor vehicle, on its registered owner, and/or on the driver’s license, and the corresponding demerit points on the driver’s record, for violation of traffic laws, rules, and regulations;
WHEREAS, consistent with the goal of providing “Serbisyong May Ngiti” to all Taytayeños, the signing of the MOA and DPA with Innovision Premier Corp. will further reinforce the Municipality’s mandate to process personal information of individuals for purposes of enforcing laws, its ordinances, rules, and regulations and imposing corresponding fines and penalties within its jurisdiction that will benefit all its constituents;
NOW THEREFORE, BE IT RESOLVED, as it is hereby resolved, by the 12th Sangguniang Bayan of Taytay, Rizal, in session duly assembled, to AUTHORIZE THE MUNICIPAL MAYOR, HON. ALLAN MARTINE S. DE LEON, MPA, TO SIGN AND ENTER INTO A MEMORANDUM OF AGREEMENT AND DATA PROCESSING AGREEMENT WITH THE INNOVISION PREMIER CORP. REPRESENTED BY ITS PRESIDENT AND CEO, MR. NOEL DELOS REYES, FOR THE INTERCONNECTION OF TRAFFIC APPREHENSION SYSTEMS WITH THE LAND TRANSPORTATION MANAGEMENT SYSTEM IN THE MUNICIPALITY OF TAYTAY, PROVINCE OF RIZAL, AND FOR OTHER PURPOSES.
RESOLVED FURTHER, that the duly signed Memorandum of Agreement and Data Processing Agreement shall be ratified first by the Sangguniang Bayan before its full implementation.
RESOLVED FINALLY, that a copy of this Resolution shall be forwarded to the Office of the Municipal Mayor, and all concerned offices in the Municipal Government of Taytay.
