A RESOLUTION RATIFYING THE MEMORANDUM OF AGREEMENT ENTERED INTO BY AND BETWEEN THE MUNICIPAL GOVERNMENT OF TAYTAY, REPRESENTED BY MUNICIPAL MAYOR HON. ALLAN MARTINE S. DE LEON, MPA AND DEPARTMENT OF HUMAN SETTLEMENTS AND URBAN DEVELOPMENT (“DHSUD”), REPRESENTED BY ITS REGIONAL DIRECTOR, DIR. JEAN PAUL C. ILAO, MPM, FOR THE SAMAHANG IKAW, KAYO, AKO AT TAYO (“SIKAT”) PROGRAM IN THE MUNICIPAL GOVERNMENT OF TAYTAY, PROVINCE OF RIZAL, AND FOR OTHER PURPOSES
WHEREAS, the Municipality Government of Taytay, has entered into a Memorandum of Agreement (“MOA”) with Department of Human Settlements and Urban Development (“DHSUD”) through Sangguniang Bayan Resolution No. 518 series of 2024 entitled, “A Resolution Authorizing the Municipal Mayor, Hon. Allan Martine S. De Leon, MPA, to sign and enter into a Memorandum of Agreement with the Department of Human Settlements and Urban Development Region IV-A, Represented by the Regional Director, Dir. Jean Paul C. Ilao, MPM, for the Samahang Ikaw, Kayo, Ako, at Tayo (“Sikat”) Program in the Municipality of Taytay, Province of Rizal, and for Other Purposes”;
WHEREAS, the Article XIII, Section 9, of the 1987 Constitution provides that, “[t]he state shall, by law, and for the common good, undertake, in cooperation with the public sector, a continuing program of urban land reform and housing which will make available at affordable cost decent housing and basic services to underprivileged and homeless citizens in urban centers and resettlements areas”;
WHEREAS, Republic Act No. 11201 created the DHSUD with mandates and functions, as provided in the Implementing Rules and Regulation (“IRR”) of the same act, through the Homeowners Association and Community Development of the Regional offices, to regulate and supervise the activities and operations of Homeowners Associations (“HOAs”), federation, and confederations;
WHEREAS, Republic Act No. 7160, otherwise known as the Local Government Code states that, “[e]very local government unit shall exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare”;
WHEREAS, the DHSUD Region IV-A has implemented the Samahang Ikaw, Kayo, Ako at Tayo (“SIKAT”) program to strengthen stakeholders’ engagement and collaboration, aiming to enhance coordination and synergy between the DHSUD and its local stakeholders, particularly HOAs;
WHEREAS, DHSUD Memorandum No. HOAACDD-23-22 dated 11 May 2023 tapped its partners in the Local Government Units (“LGUs”) to implement the program which shall be carried out pursuant to a MOA between the DHSUD and the LGU Local Housing Board;
WHEREAS, the SIKAT program seeks to address the challenges faced by homeowners associations, including difficulties in accessing difficulties in accessing streamlined coordination with the DHSUD Regional Office for document processing, compliance requirements, and other related matters;
WHEREAS, the Municipality of Taytay recognizes the importance of fostering partnerships with national government agencies such as DHSUD to promote sustainable urban development and address the needs of local communities, particularly those involving housing and human settlements;
WHEREAS, the Municipality of Taytay stands to benefit from the SIKAT program by enabling the efficient resolution of issues and concerns raised by local HOAs, improving transparency, and building trust between stakeholders and the government;
WHEREAS, the partnership with DHSUD Region IV-A under the SIKAT program is in line with the Municipal Government’s commitment to enhancing public service delivery, particularly in the areas of housing and urban development;
WHEREAS, the Sangguniang Bayon deems it proper to ratify the Memorandum of Agreement that was signed last 6th of December 2024 by Municipal Government of Taytay and DHSUD Region IV-A through their respective representatives;
WHEREAS, consistent with the goal of providing Serbisyong May Ngiti to all Taytayeños, the ratification of the MOA with the DHSUD Region IV-A is needed to fully support and implement the initiative that can further reinforce the Municipality’s mission that is beneficial to its constituents;
NOW THEREFORE, BE IT RESOLVED, as it is hereby resolved, by the 12th Sangguniang Bayan of Taytay, Rizal, in session duly assembled, hereby RATIFIES THE MEMORANDUM OF AGREEMENT ENTERED INTO BY AND BETWEEN THE MUNICIPAL GOVERNMENT OF TAYTAY, REPRESENTED BY MUNICIPAL MAYOR HON. ALLAN MARTINE S. DE LEON, MPA AND DEPARTMENT OF HUMAN SETTLEMENTS AND URBAN DEVELOPMENT (“DHSUD”), REPRESENTED BY ITS REGIONAL DIRECTOR, DIR. JEAN PAUL C. ILAO, MPM, FOR THE SAMAHANG IKAW, KAYO, AKO AT TAYO (“SIKAT”) PROGRAM IN THE MUNICIPAL GOVERNMENT OF TAYTAY, PROVINCE OF RIZAL, AND FOR OTHER PURPOSES.
RESOLVED FINALLY, that copy of this Resolution be furnished to all concerned for their information and appropriate action.
