Ordinance No. 808 series of 2024
AN ORDINANCE PROHIBITING LOITERING IN PUBLIC PLACES, AND PLACES OPEN TO THE GENERAL PUBLIC SPECIFICALLY AROUND SCHOOL PREMISES IN THE MUNICIPALITY OF TAYTAY, PROVINCE OF RIZAL
WHEREAS, Article II, Section 5 of the 1987 Constitution states that, “The maintenance of peace and order, the protection of life, liberty, and property, and the promotion of the general welfare are essential for the enjoyment by all the people of the blessings of democracy”;
WHEREAS, Section 16 of the Local Government Code states that, “Every local government unit shall exercise the powers expressly granted, those necessarily implied there from, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare…”;
WHEREAS, there are occurrences of loitering that affect the safety and welfare of the general public, causes inconveniences and impediment to pedestrian passage, and hinders the flow of vehicular and foot traffic in several locations within the Municipality of Taytay;
WHEREAS, it has been one of the leading causes of misconduct against property and individuals, as well as other street crimes, particularly surrounding school grounds;
NOW THEREFORE, BE IT ORDAINED, by the 12th Sangguniang Bayan of Taytay that:
Section 1. Short Title - This Ordinance shall be known as the “Taytay Anti-Loitering Ordinance of 2024”.
Section 2. Definition of Terms - As used in this Ordinance, the following term shall mean:
a) Loitering - to remain idle in a location without apparent reason or intent, standing or gathering upon any public space so as to obstruct, or tend to obstruct the passage of pedestrians or vehicular traffic flow.
b) School Premises - all property owned, leased, subleased, licensed, or operated by a specific school district including, but not limited to, all buildings and grounds, entertainment and educational facilities, auditoriums and halls used by the district and/or student, parents, staff or faculty groups, school organizations or event within 200m radius from the school grounds.
c) Public Place - a place located at the Municipality of Taytay, Province of Rizal which the general public, or a significant group of people, have access, including, but not limited to, streets, highways, sidewalks, parking lots, vacant lots or any unsupervised place, parks, and the common areas in and about churches, apartment buildings, office buildings, hospitals, schools, shops and places of entertainment such as movie theaters and similar places and business establishments.
Section 3. Prohibited Acts - The following acts of Loitering, penalized under Section 5 hereof, shall include the following:
(a) Create or cause to be created, a danger or a breach of peace;
(b) Hinder or obstruct, or tend to hinder or to obstruct, the free passage of pedestrians or vehicular traffic;
(c) Obstruct, molest, or interfere with a person in such a manner as to cause them fear for their safety;
(d) Disturb the comfort and repose of a person acting lawfully by such action as making unsolicited remarks of an offensive, disgusting, threatening or insulting or which are calculated to annoy or disturb the person to whom made or in whose hearing they are made; and
(e) To stay idle in essentially one location and shall include the concept of spending time idly, loafing, or walking about aimlessly, and of standing or gathering upon any public place around the school premises so as to hinder or impede, or tend to hinder or impede the passage of pedestrians or vehicular traffic.
Section 4. Deputization of the Implementers - The following are deputized to enforce the provision of this Ordinance:
- Philippine National Police – Taytay,
- All Barangay Peacekeeping Teams, Task Forces, and outpost personnel within Taytay, Rizal, and
- All other groups or individuals deputized by the Municipal Mayor or the Punong Barangay.
Section 5. Penal Provision - For every violation of the provisions of this Ordinance shall equation the following penalties:
1st Offense - Reprimand
2nd Offense - Php 500 fine
3rd Offense - Php 2,500 fine
Section 5.1 If the violator is a minor, the first and second offense penalty shall be imposed with MSWD Intervention. The violator shall be turned over to MSWD for proper action.
Section 6. Public and Private Schools - Any student of Public and Private Schools who violates any part of this Ordinance and is subject to intervention shall switch to modular learning during the period of intervention.
Section 7. Municipal Social Welfare and Development - The Municipal Social Welfare and Development Office, together with the Barangay, shall keep records of violators and that copies of it shall be forwarded to respective schools for their information.
Section 8. Municipal Public Safety Department - The Municipal Public Safety Department shall ensure the safety of the students, teachers, and other school personnel within the surroundings of both public and private schools.
Section 9. Barangay - The Barangay concerned shall provide personnel to patrol around schools under their jurisdictions.
Section 10. Education and Information Dissemination - The Municipality, the Barangay, and the Municipal Social Welfare and Development Office, the Public Information Office, and both public and private Schools in Taytay shall conduct an information and campaign drive in all schools and barangays regarding the Anti-Loitering drive of the Municipality in coordination with their respective Parent-Teacher Associations and Student Government Bodies.
Section 11. Separability Clause - If any part of this Ordinance is declared not valid, unconstitutional, or unlawful, such declaration shall not affect or impair the remaining provisions, sections, or parts thereof, which shall remain or continue to be in full force and effect.
Section 12. Repealing Clause - All previous ordinances inconsistent with this Ordinance shall be deemed repealed or modified accordingly.
Section 13. Effectivity Clause - This Ordinance shall take effect fifteen (15) days after its posting in conspicuous places and in the local bulletin board.
