Resolution No. 440 series of 2024
A RESOLUTION AUTHORIZING HON. ALLAN MARTINE S. DE LEON, MPA, MUNICIPAL MAYOR; ATTY. ALDRICK DAVEN M. MENDOZA, MPA, MUNICIPAL ADMINISTRATOR; AND HERLITO A. BASCO, MUNICIPAL TREASURER, TO SIGN ON BEHALF OF THE MUNICIPAL GOVERNMENT OF TAYTAY, PROVINCE OF RIZAL ALL FINANCIAL TRANSACTIONS RELATING TO ITS BANK ACCOUNTS WITH DEVELOPMENT BANK OF THE PHILIPPINES, AND TO OPEN BANK ACCOUNTS WITH THE SAME, AND FOR OTHER PURPOSES
WHEREAS, Republic Act (“R.A”) No. 85 as amended by Presidential Decree No. 1461, otherwise known as the DBP Charter, states that “[t]he Development Bank of the Philippines is a Government Agency entrusted with the task of providing credit facilities for the rehabilitation, development and expansion of the country’s agriculture and industry, the reconstruction of property damaged by war, the broadening and diversification of the national economy and the promotion and establishment of private development banks in the provinces and cities”;
WHEREAS, R.A. No. 7160, otherwise known as the Local Government Code of 1991, states that the Municipal Mayor shall, upon authorization by the Sangguniang Bayan, represent the municipality in all its business transactions and sign on its behalf all bonds, contracts, and obligations, and such other documents made pursuant to law or ordinance;
WHEREAS, Section 345 of R.A. No. 7160 provides that “[c]hecks in settlement obligations shall be drawn by the local treasurer and countersigned by the local administrator”;
WHEREAS, Section 470 (d)(2) of R.A. No. 7160, provides that “[t]he treasurer shall take charge of the treasury office, perform the duties provided for under Book II of the Code, and shall take custody and exercise proper management of the funds of the local government unit concerned”;
WHEREAS, Sangguniang Bayan Resolution No. 268, Series of 2023, authorized Atty. Aldrick Daven M. Mendoza, MPA, Municipal Administrator, to sign for on behalf of the Municipality of Taytay all warrants drawn with the account corresponding to the executive department maintained by the Municipal Government of Taytay;
WHEREAS, there is a necessity to authorize Hon. Allan Martine S. De Leon, MPA, Municipal Mayor; Atty. Aldrick Daven M. Mendoza, MPA, Municipal Administrator; and Herlito Basco, Municipal Treasurer, as official signatories of all business and transactions of Municipality of Taytay with the Development Bank of the Philippines, except those involving the Sangguniang Bayan;
WHEREAS, consistent with the goal of providing Serbisyong May Ngiti to all Taytayeños, the opening of bank account for various transactions and businesses will secure the funds, and financial mechanism of the Municipality;
NOW THEREFORE, BE IT RESOLVED, as it is hereby resolved, by the 12th Sangguniang Bayan of Taytay, Rizal, in a session duly assembled, hereby AUTHORIZES HON. ALLAN MARTINE S. DE LEON, MPA, MUNICIPAL MAYOR; ATTY. ALDRICK DAVEN M. MENDOZA, MPA, MUNICIPAL ADMINISTRATOR; AND HERLITO A. BASCO, MUNICIPAL TREASURER, TO SIGN ON BEHALF OF THE MUNICIPAL GOVERNMENT OF TAYTAY, PROVINCE OF RIZAL ALL FINANCIAL TRANSACTIONS RELATING TO ITS BANK ACCOUNTS WITH DEVELOPMENT BANK OF THE PHILIPPINES, AND TO OPEN BANK ACCOUNTS WITH THE SAME.
RESOLVED FURTHER, that a copy of this Resolution shall be forwarded to the Office of the Municipal Mayor, and all concerned offices in the Municipal Government of Taytay.
ADOPTED, this 22nd day of July 2024, 3:53 PM at the Sangguniang Bayan Session Hall, Municipality of Taytay, Province of Rizal.
