Ordinance No. 727 series of 2021
APPROPRIATING THE AMOUNT OF ONE BILLION SIX HUNDRED THIRTY-EIGHT MILLION SIX HUNDRED SEVENTEEN THOUSAND SEVENTY PESOS (PHP 1,638,617,070.00) AS THE ANNUAL BUDGET OF THE MUNICIPALITY OF TAYTAY, PROVINCE OF RIZAL FOR FISCAL YEAR 2022
By virtue of the power by Republic Act 7160, otherwise known as the Local Government Code of 1991, the Sangguniang Bayan of Taytay, Rizal, assembled in session duly called for public, do hereby ORDAINED that:
SECTION 1. The estimated revenue and other sources of funds duly certified by the Municipal Finance Committee as to reasonableness of collection on the present economic condition and existing tax ordinance is hereby estimated at ONE BILLION SIX HUNDRED THIRTY-EIGHT MILLION SIX HUNDRED SEVENTEEN THOUSAND SEVENTY PESOS (PHP 1,638,617,070.00).
SECTION 2. The total estimated income of ONE BILLION SIX HUNDRED THIRTY-EIGHT MILLION SIX HUNDRED SEVENTEEN THOUSAND SEVENTY PESOS (PHP 1,638,617,070.00) is hereby appropriated to various expenditures needed to carry out functions, projects, and activities of the Municipality of Taytay for the Fiscal Year 2022.
SECTION 3. This Appropriation Ordinance shall contain the Local Expenditure Program presented per Department / Office in the following manner:
1. Receipts Program
2. Proposed New Appropriations by Programs, Activity and Project
3. Proposed New Appropriations by Object of Expenditures
4. Plantilla of Personnel
5. Special Provisions
6. Summary of the FY 2022 Proposed New Appropriation
SECTION 4. Included in this Appropriation Ordinance is the implementation of the Third Tranche of RA 11466 or The Salary Standardization Law of 2019; Also included is the funding for creation of several plantilla positions needed by the Municipality specially in line with the implementation of the Devolution Transition Plan (DTP) of the National Government per Executive Order (EO) No. 138, s. 2021. A separate Ordinance shall be passed for the official creation of said positions.
SECTION 5. Provisions for Terminal Leave Benefits of all retirable, resigned and deceased employees are considered in this year 2022.
SECTION 6. Appropriations for the 5% MDRRMF or the Municipal Disaster Risk Reduction & Management Fund is in accordance with the provisions of RA 10121 or the Philippine Disaster Risk Reduction and Management Act of 2010 and its Implementing Rules and Regulations. The related MDRRM Plan was approved by the MDRRM Council and ratified by this Sanggunian.
SECTION 7. Development Programs, Projects and Activities in the 20% Development Fund was approved by the Municipal Development Council and ratified by this Sanggunian and in accordance with the provisions of DILG / DBM / DOF Joint Memorandum Circular No. 1 dated November 4, 2020.
SECTION 8. Devolution Transition Plan (DTP) per Executive Order No. 138, s. 2021 was approved by the Sangguniang Bayan on November 9, 2021. Provisions under Section 17 of the Local Government Code for the functions, services and facilities will be fully devolved to the Local Government Units by phasing starting Budget Year 2022.
SECTION 9. This Appropriation Ordinance is a Gender Responsive Budget, no less than 5% of its Projects, Programs and Activities are attributable to GAD Issues and Concern. The related GAD Program / Plan was ratified by this Sanggunian.
SECTION 10. The execution of this Budget shall comply with budgetary guidelines and procedures prescribed in the Budget Operations Manual for Local Government Units.
10.1 The disbursement of authorized expenditures shall be based on approved work and financial plan and the advice of allotment issued by the Local Chief Executive.
10.2 The release of these funds are subject to the usual accounting and auditing rules and regulations.
SECTION 11. The Honorable Mayor is hereby authorized to enter into contracts, approve and ratify the same relative to the implementation of this budget. He shall act in accordance with the existing rules and regulations.
SECTION 12. In accordance with Section 336 of RA 7160 or the Local Government Code of 1991, the Mayor and the Presiding Officer of the Sanggunian are authorized to augment any item in the approved annual budget of their respective appropriations.
SECTION 13. The execution of this Appropriation Ordinance whenever applicable shall be governed by the provisions of RA 9184 or the Government Procurement Reform Act and its Implementing Rules and Regulations.
SECTION 14. Separability Clause – If, for any reason, any Section or provision of this Appropriation Ordinance is disallowed in Budget Review or declared invalid by proper authorities, other Sections or provisions hereof that are not affected thereby shall continue to be in full force and effect.
SECTION 15. Effectivity – The provisions of this Appropriation Ordinance shall take effect on January 1, 2022.
15.1 Any changes in this budget shall be made in accordance with the provisions of Section 321 and 336 of RA 7160.
RESOLVED FURTHER, that copies of this Ordinance be furnished to all concerned for their information and appropriate action.
